These Terms of Sale govern purchases of products and industrial 3D printing services and other types of machining made through solidform.ch, by telephone or by email. This document is drafted in clear and concise terms; in the event of a conflict with mandatory Swiss law, the latter shall prevail.

1. About Solidform and scope of these terms

These Terms of Sale apply to the relationship between Solidform Sagl, with its registered office at Via Sacerdote Giuseppe Caroni 2, Rancate, Canton Ticino, and anyone purchasing online at www.solidform.ch, by telephone or by email.

They apply to both business customers (B2B) and private customers (B2C), unless otherwise stated.

Solidform may amend them at any time: the version published on the website at the time of the order is binding. Amendments do not affect orders already confirmed.

The Customer must expressly accept them — by ticking the relevant box on the website, or by making an equivalent declaration for telephone or email orders — before the contract is concluded.

2. Subject of the contract and services offered

Solidform sells on-demand additive and subtractive manufacturing services through www.solidform.ch, by telephone or by email, using the following technologies:

  • Multi Jet Fusion (MJF)
  • Stereolithography (SLA)
  • Fused Deposition Modeling (FDM)
  • Selective Laser Melting (SLM)
  • Binder Jetting
  • Vacuum Casting
  • CNC machining

using plastics, resins and metals (including, by way of example, 316L stainless steel, aluminium, titanium, cobalt-chromium and copper).

The contract may be concluded online through the configurator, or by email or telephone. Products are manufactured on the basis of files and technical specifications supplied by the Customer, or selected from catalogue products where available.

3. Technical advice

Basic technical advice aimed at defining the order is generally free of charge. If a request involves an above-average amount of advisory work, Solidform reserves the right to offer the service at CHF 70.00/hour, subject to prior written agreement with the Customer (email is sufficient). A maximum spending limit may be agreed upon request; Solidform will promptly inform the Customer when that limit is reached.

4. Pre-purchase information

Before confirming the order, the Customer receives the following information:

  • total price, including taxes, shipping costs and any other charges;
  • accepted payment methods;
  • expected delivery times;
  • Solidform’s contact details (section 22).

5. Ordering procedure

The Customer may request a quotation and place an order through one of the following channels.

Telephone

Solidform staff guide the Customer through the request and order confirmation, followed by written confirmation by email.

Email

The Customer receives a reply containing all transaction details (product, price, timing and payment terms).

Online — configurator

  1. Registration: email address and name; full billing and shipping details are required to complete the purchase.
  2. Upload the file (STL, STEP or equivalent format) to the quotation section.
  3. Configuration: select the technology, material, finish, quantity and delivery times, and add any notes.
  4. Add one or more items to the cart.
  5. Check the cart: product, quantity, unit and total price, order fulfilment (courier/post, On-Site pickup) and shipping costs.
  6. Order confirmation: select the shipping address (which may differ from the billing address) and complete the billing details.
  7. Select the payment method and confirm the order.

Quotations generated on the basis of incorrect, incomplete or not yet available files are indicative and non-binding: the final price may change following a technical review of the data.

Solidform reserves the right, on reasonable grounds (e.g. suspected fraud, ongoing payment disputes, insufficient data or breach of these terms), to refuse, suspend or cancel an order at any time, informing the Customer accordingly.

6. Conclusion of the contract

The contract is deemed concluded when Solidform confirms acceptance of the order in writing (email is sufficient), stating the Customer’s details, order number, price, shipping costs, delivery address and a link to these terms.

Any subsequent amendments to the contract are valid only if made in writing. The Customer is responsible for the accuracy of their details and must promptly notify Solidform of any necessary corrections.

7. Shipping and delivery

Unless otherwise agreed, delivery takes place within a maximum of 30 days of conclusion of the contract and receipt of payment, where advance payment is required. Delivery times are communicated to the Customer before order confirmation, not afterwards.

Delivery area: Switzerland.

Exceeding the delivery deadline for reasons not attributable to Solidform (operational disruptions, strikes, shortages of energy or raw materials, force majeure) does not entitle the Customer to withdraw from the contract or claim compensation. For delays attributable to Solidform, liability is in any event limited to the value of the goods ordered.

8. Prices, VAT and shipping costs

Quotations are provided after the Customer submits the file; any changes to the file require a new quotation.

Quotation validity: 15 days; after this period, prices may change without notice.

Unless otherwise agreed, prices are stated in CHF, net and inclusive of VAT where applicable. Shipping costs are shown in the cart and summarised before order confirmation, as well as in email correspondence.

In the event of a pricing error, Solidform promptly contacts the Customer for clarification; if no agreement is reached, the order is cancelled by written notice and any amounts paid are refunded.

9. Payments

Accepted payment methods:

  • Bank transfer
  • Credit card (other methods via Stripe or an equivalent provider)

For orders placed through the online configurator, payment is generally required in advance upon order confirmation. For orders placed by businesses via quotation/email, unless otherwise agreed, payment is due within 15 days net of the delivery date.

Late payment and reminders

If the payment deadline expires without payment, the Customer is automatically in default and statutory default interest accrues on the amounts due. The first reminder, sent by email, is free of charge.

A second reminder, normally issued 10 days after the first, incurs an administrative fee of CHF 20.00

10. Invoicing

The invoice is issued upon ordering or delivery of the product, depending on the channel used, and sent to the Customer by email in PDF or equivalent format.

11. Returns and order cancellation

A) Cancellation before production begins

The Customer may request free cancellation of the order within 4 hours of confirmation, provided production has not yet begun, by writing to orders@solidform.ch.

B) No statutory right of withdrawal

Unlike EU consumer protection legislation, Swiss law does not provide a general 14-day right of withdrawal for distance purchases, unless otherwise agreed.

Products manufactured to the Customer’s specifications (custom-made, based on personalised files and configurations) cannot be cancelled or returned once production has begun, except as provided in point A) or otherwise agreed in writing.

C) Returns for defects, delivery errors or quantity discrepancies

  1. Report the problem by email to orders@solidform.ch as soon as it is discovered.
  2. Return the product with accessories, complimentary items and documentation in its original packaging.
  3. Send everything to Solidform’s registered office for inspection.

Return shipping costs are borne by Solidform if the claim is found to be justified following an internal inspection. Solidform refuses returns showing signs of wear, use or damage not attributable to the reported defect.

D) Non-returnable products

Personalised products or products manufactured to the Customer’s specifications are not returnable or refundable, except in the case of a defect attributable to Solidform.

E) Refunds

Refunds are made using the same payment method used by the Customer, normally within 14 days of verification of the return or cancellation conditions.

12. Statutory warranty and notification of defects

The statutory warranty period of two years from transfer of the goods to the Customer applies (Art. 197 et seq. of the Swiss Code of Obligations, CO).

The Customer must inspect the goods received and immediately report any defects in quality (in particular tolerances, surface finish and strength) or quantity. In the absence of prompt notification, the delivery is deemed accepted. The provisions of Art. 371 CO apply to hidden defects.

If a claim is justified, Solidform remedies the defect within a reasonable period. Price reductions and termination of the contract are excluded, unless otherwise provided by law.

Disputed parts must not be disposed of, modified or processed further: at Solidform’s request, they must be returned for inspection, unless a different procedure has been agreed.

13. Dimensional tolerances and material characteristics

Standard industry deviations in machining and materials are reserved. Unless otherwise agreed or specified, indicative tolerances are in the range of >100mm ± 0.1mm, <100mm ± 0.2mm; these values vary according to the technology, material and geometry of the part and cannot be guaranteed absolutely, as they depend on several process parameters typical of additive manufacturing and CNC machining.

Manufactured products may contain substances required for the production process and, depending on the material, may not be particularly resistant to heat, impact or contact with liquids. Unless suitability is expressly guaranteed by Solidform, products are to be considered suitable for models, samples, prototypes and technical components according to specification, and not for uses other than those agreed.

Some products may contain small parts: they are not suitable for young children due to the risk of choking if swallowed or inhaled.

14. Product descriptions

Solidform undertakes to provide accurate and complete information about products published on www.solidform.ch, without, however, giving an absolute guarantee as to the accuracy, reliability or completeness of those descriptions.

15. Limitation of liability

The product ordered is conceived, designed and commissioned in all its characteristics by the Customer, who assumes full responsibility for it and acknowledges that Solidform assumes no responsibility for the product other than ensuring that the manufacturing work conforms to what was commissioned.

Solidform is not liable for defects arising from incorrect, incomplete or non-compliant files or data supplied by the Customer, nor for the loss of files submitted for processing.

Solidform expressly excludes all liability in the event of improper use of the products supplied. Liability is limited to gross negligence; all liability for indirect or consequential damages is excluded, and in any event for any amount exceeding the value of the goods ordered, unless otherwise provided by mandatory law.

16. Intellectual property, data and confidentiality

Intellectual property rights in files and models supplied by the Customer remain with the Customer, who warrants that they own those rights and are entitled to have them reproduced and printed by Solidform.

Solidform does not retain or return files supplied by the Customer beyond the time necessary to fulfil the order, unless otherwise agreed in writing.

Solidform treats the Customer’s files and technical information confidentially. At the Customer’s request, and at no additional cost, Solidform is willing to sign a non-disclosure agreement (NDA) before files are shared.

17. Export regulations and compliant use

Certain components manufactured by Solidform (e.g. titanium, cobalt-chromium or other metal alloys) may be subject to Swiss and international export control and dual-use goods regulations.

The Customer undertakes to comply with these regulations and warrants that the products purchased are not intended, directly or indirectly, for prohibited uses (including armament or weapons of mass destruction programmes) or for persons, entities or countries subject to sanctions or embargoes.

18. Data protection

The Customer’s personal data is processed in accordance with the Swiss Federal Act on Data Protection (revised FADP) and, where applicable to customers in the European Union, the General Data Protection Regulation (GDPR).

19. Feedback

Suggestions, comments and reports voluntarily sent by the Customer to Solidform may be freely used by Solidform to improve products and services, without any compensation to the Customer.

20. General provisions

If one or more provisions of these terms are or become invalid or unenforceable, this does not affect the validity of the remaining provisions.

Solidform is not liable for errors or delays caused by circumstances beyond its reasonable control (force majeure).

These Terms of Sale constitute the entire agreement between the parties relating to the order of products or services and supersede all prior agreements or understandings, whether written or oral, on the same subject matter.

Solidform’s failure to enforce any provision of these terms does not constitute a waiver of that provision.

21. Applicable law and jurisdiction

These terms and every contractual relationship with the Customer are governed exclusively by Swiss law, excluding conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG).

The competent court is the ordinary court at the place of Solidform’s registered office (Canton Ticino, Lugano), without prejudice to Solidform’s right also to bring proceedings before the court at the Customer’s domicile.

By confirming the order, the Customer declares that they have read and accepted these Terms of Sale.
